Act A1737: Arbitration (Amendment) Act 2024 will come into operation on 1 January 2026. This is an Act to amend the Arbitration Act 2005.
The Arbitration (Amendment) Act 2024, enacted to align Malaysia’s arbitration framework with the UNCITRAL Model Law, introduces several key reforms. Among others, it streamlines the recognition and enforcement of arbitration awards by allowing them to be binding without the need for a High Court application, broadens the definition of a written arbitration agreement to include electronic or document exchanges, and introduces third-party funding provisions requiring the disclosure of such arrangements to ensure transparency. The Act also strengthens the organisational framework of the Asian International Arbitration Centre (AIAC) in line with the Supplementary Agreement between the Government of Malaysia and the Asian-African Legal Consultative Organisation (AALCO).
